Panache Digilife Limited having its registered office at Bldg.A3, 102-108 & 201-208, Babosa Industrial Park, Mumbai-Nashik Highway NH3, Saravali Village, Bhiwandi, Thane – 421302, hereinafter referred to as “Company” warrants that the Aquatatva Brand of Water ionisers by Panache Digilife Limited “Product”, shall be free from any manufacturing defect for a period of one (1) year from the date of purchase by end user (“Customer”/ “Panache”), on the following terms and conditions and as the case may be with free of charge repairs of part(s) for “Product”, if proved upon inspection by the Company or any of its authorized Dealer/Service Centre, to be defective due to faulty material or workmanship.
The above mentioned warranty shall be valid for all functional parts for a period of one year from the date of purchase by customer as mentioned on Purchase Invoice (“Warranty Period”) This warranty covers only the repairs and does not entitle the Customer for replacement of the Product including but not limited to free replacements of cabinets and styling materials aesthetic material frames, plastic parts & accessories/consumables such as inline Cartridge, sediment & Carbon Cartridge, water hose pipe, etc. The Company shall provide such warranty services through its authorized Dealer / Service Centre. The following services shall be free of cost during the Warranty Period.
Breakdown Complaints: The Company will put its best efforts to promptly attend to any breakdown complaint lodged by the Customer. Company shall carry out repairs if it is determined by the Company’s authorized service representative that these are due to the manufacturing defects.
The aforementioned warranty shall be subject to the below mentioned conditions:

  1. The Customer has to provide original Purchase invoice and warranty card having Company / Dealer stamp and date of purchase at the time of requesting the warranty services, failing which the warranty will not be honoured.

  2. Total Warranty Period is limited as provided hereunder from the date of customer’s Purchase Invoice irrespective of the period for which the Product / unit was not in use; was not giving proper performance; was under breakdown or was under repair(s) by Company’s authorized service centre.

  3. In the event of repairs, of any part, during the said Warranty Period, the warranty shall thereafter continue only for the unexpired period of the original warranty Period. The defective part(s) shall become the property of the Company.

  4. The Company reserves the right to decide at its discretion, for replacing any defective part with a substitute without affecting the performance of the Product. Panache reserves the right to replace the defective part with an equivalent and/or reconditioned part.

  5. product based on customer demand is not covered under warranty & shall beRe-installation or de-installation of chargeable to customer.

  6. This warranty shall not apply with respect to the Products or any part thereof which has been subject to Installation/repair by any unauthorized persons or repair/use of this Product or any accessories other than those specified by Company; any accident or damage during transit; mishandling, dust, unauthorized modifications, precipitates or biological growth, input voltage beyond specifications, riots, commercial use, lightning, use contrary to the operations specified in the user’s manual supplied with the Product/unit, alteration; there is no Aquatatva and Panache Hologram, Unit/part(s) Serial No. mutilated, defaced or altered; Fire; Flood or such occurrences; water, Presence of any foreign object or living creature (eg. Rat, lizard, insect, ants, etc.) inside the Product unit; use of harmful chemicals; Improper heat load, Usage of Product / unit in an abnormally corrosive alkaline/acidic atmosphere; Any change or defect resulting due to misuse, neglect or improper maintenance

  7. This warranty is valid only in India.

  8.  And this warranty is limited to the first purchaser of the product only and is non-transferable

  9. The warranty is covered and valid only when the Product is operated / used with normal municipal water at a temperature below 40°C.

  10. This warranty does not cover any damage on Feather touch buttons of Product and damage caused to the Alkaline hose of the Product.

  11. This Warranty shall not include 3rd party products like a reverse osmosis purifier or accessories.

  12.  The Company shall not be liable or be deemed to be in default for any delay or failure in performance resulting directly or indirectly from causes beyond its reasonable control including delay in repairing due to non-availability of any component or accessory, labour problem, restrictions and regulations of the government, epidemic, pandemic, public movement, war and any unavoidable circumstances, specially vis-à-vis the import of supplies, sickness / illness / death due to consumption of drinking water from improperly maintained product and raw material or if the Company is otherwise prevented from performing its functions under this warranty.

  13.  All services under this Warranty shall be withheld if the payments (including interest) towards the products are in default.

  14. The warranty extended herein is in lieu of implied conditions and warranties under the law, and is confined to the repair(s) of defective parts and does not cover any consequential or resulting liability, damage or loss arising from such defects. Furthermore, the warranty in no case shall extend to the payment of any monetary consideration whatsoever or the replacement or return of the Product as a whole. 

  15. Any defect in the electrical/plumbing installation or wiring/piping at site has to be rectified by the Customer as per the recommendation of Company’s Authorized service representative.

  16.  In the event of any difference or dispute arising with reference to the terms and conditions of this warranty or their interpretation, the same shall be referred to a sole arbitrator, who shall be appointed by the Company. The decision of the sole arbitrator shall be final and binding on the parties. Such arbitration proceedings shall be held at Mumbai and provision of the Arbitration & Conciliation Act 1996 shall apply to the arbitration proceedings.

  17.  The Agreement is subject to the jurisdiction of civil courts at Mumbai only.

  18.  To the extent permitted by law, any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance of offer, invoice or other documents or information issued by Company shall be subject to correction without any liability on the part of Company.

  19.  This warranty does not cover cost of labour, transportation of the Product from the place of installation to the Authorized service centre and other incidental expenditures, which shall be borne by the Customer. 

  20.  While the Company will make every effort to carry out repairs at the earliest, it is however made explicitly clear that the Company is under no obligation to do so in a specified period of time. 

  21.  Nothing in this Agreement shall give customer any right, title or interest in any information, or any copyrights, trademarks, patents or trade secrets owned by / licensed to Panache.

  22.  To the extent permitted by law, this Warranty and the remedies set forth herein are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Company disclaims all statutory and implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects, to the extent permitted by law. In so far as such warranties cannot be disclaimed, Company limits the duration and remedies of such warranties to the duration of this express Warranty and, at Company's option, the repair or replacement services described below. 

  23.  The Company's obligation under this warranty shall be limited to repair of part/s only. The maximum amount of liability with respect to any Product related claim/s, if entertained by Company, will be subject to the maximum retail price of the Product purchased or the purchase price, whichever is lower. 

  24.  Replacement of parts would be purely at the discretion of Company alone. In case the replacement of any part / entire product is being made, (subject to the sole discretion of Company), the same part / model shall be replaced and in the event such part / model has been discontinued, it shall be replaced with the part / model equivalent as deemed by Company Customer Do’s in case of Aquatatva Water Ionizer Product

    •  For the optimal performance of Water Ionizer, use in accordance with the instructions given in the instruction manual. 

    • Operate Water Ionizer under normal municipal water (TDS above 60PPM and below 100 PPM) at a temperature below 40°C. 

    • Water Ionizer must be repaired by an authorized person of Company only and the serial number of the Water Ionizer should not be deleted or altered. 

    • Relocation of installed Water Ionizer shall be undertaken by authorized person of Company only at cost of customer. 

    •  Customer should preserve & provide original Invoice and warranty card for claiming warranty.

    •  Do check the total dissolved solids (TDS) of municipal water of your tap water before installation, to protect your Ionizer from all the damages caused by the inlet water. 

    •  In the event Water Ionizer requires attention, please call the customer care within 24 hours from the inception of the issue.

Warranty Process

  1.  To claim the services under this warranty, Customers must log the issue with Company at the issue logging contacts. 

  2. The customer shall apprise the Company with the serial no. and invoice details of the product along with the issue faced by the Customer.

  3.  Upon verification of details provided to Company by Customer, Company shall log the issue.

  4.  Company shall try to resolve the issue via remote problem rectification. Customer is responsible to provide a person for help and support onsite for providing first-hand information of problem and carry out certain diagnostic actions as directed on call/mail by Company. 

  5. If reported problem not solved remotely as mentioned above, on site visit shall be arranged either by Panache personnel / its authorised person. 

  6. Issues occurring due to power plug fluctuations, mishandling of setup / tags at Customer’s end etc. will not be covered under the Panache’s warranty obligations. 

  7. Once the issue is resolved, Customer shall be intimated about the issue closure. 

  8. Pre-requisites for remote diagnostics - High speed uninterrupted internet connection and Provision of Video call for remotely monitoring the setup problem.
